"Bad Apple" Gun Dealers: The Brady Campaign's Latest Assault on the Second Amendment

In a spate of recent cases filed in state courts across the country, the Brady Campaign to Prevent Gun Violence is utilizing state laws including negligent entrustment, negligence per se and public nuisance to circumvent the protections afforded by the Protection of Lawful Commerce in Arms Act (PLCAA). This presentation will examine the PLCAA as well as review selected cases filed by the Brady Campaign with an emphasis on developing litigation strategies to protect Federal Firearms Licensees from abusive and potentially bankrupting lawsuits.
